DISCLAIMER, TERMS OF PARTICIPATION & DATA PROTECTION

1. General Information

Participation in the event organized by the organizer is at the participant’s own risk. Registration via the organizer’s website constitutes an application to participate in the selection process. There is no entitlement to participate in the event. Registration for the ORTOVOX SAFETY ACADEMY WEEKEND pool begins on 07 April 2025 at 08:00 CET and ends on 04 May 2026 at 23:59 CET. The final participants will be selected based on their submissions and notified by email. By registering, the participant agrees to these terms and conditions of participation.

2. Nature of Participation 

Participation in the selection process does not constitute a raffle, prize competition, or lottery. No free or sponsored package will be awarded. Selected participants will have the opportunity to purchase a participation package for the ORTOVOX SAFETY ACADEMY WEEKEND, including accommodation, meals, and access to the program.

3. Selection Process and Evaluation Criteria

Participants are selected based on the submitted text. Submissions will be evaluated in particular according to the following criteria:  

Authenticity & Emotional Impact 

The text should be credible, personal, and genuine. We want to understand why the applicant and their buddy wish to participate in the Bike Safety Academy Weekend and what personal connection they have to ORTOVOX. Emotional elements, authentic motivation, and a clear, understandable attitude are particularly important.

Creativity

Creative approaches, original imagery, or a fresh perspective on the topic of bike safety are rated positively. It is essential that despite creativity, the text remains clearly understandable and highlights both the topic of “safety” and the shared passion for mountain biking.

Safety & Responsibility

The text should convey the importance of safety in mountain sports for the applicant. This may relate to their personal approach to risk as well as their responsible behavior towards their group or nature.

A jury consisting of representatives of ORTOVOX will select the final participants based on these criteria. Legal recourse is excluded.

4. Requirements for Participation

a) Participation is open to persons aged 18 and over. Minors may only participate if written permission from a legal guardian is provided before the event begins.

b) All participants must meet the requirements stated in the respective call for applications regarding experience, fitness, and equipment.

5. Health Condition and Personal Responsibility

a) The participant confirms that they are medically fit to take part in the event. No medical examination will be conducted by the organizer. 

b) The participant is responsible for realistically assessing their own physical and mental capacity. 

c) Participants who do not meet the requirements may be partially or fully excluded from the event. 

d) Participants are responsible for informing the organizer prior to the event about any health limitations or known risks.

6. Costs and Payment Terms 

Participation in the ORTOVOX SAFETY ACADEMY WEEKEND is subject to a fee. Selected participants purchase a participation package including the following services:

  • Breakfast, dinner, and accommodation at Hotel Etschquelle in Reschen (IT): 3 nights: 289€ per person incl. accommodation in double rooms (96€ per person per day)
  • Accommodation in double rooms with an accompanying person — single participation is not possible due to limited bed capacity
  • Lunch at selected mountain huts: €50 per person (Friday & Saturday)
  • 3 day lift pass: €112.05 per person

Payment Terms

After contacting the selected participants, a deposit of €170 per person must be paid within 7 days of receiving the payment request. The remaining balance must be paid on-site at Hotel Etschquelle. If the deposit is not paid in time, the entitlement to participate expires and the spot may be allocated to another person.

7. Withdrawal and Refund Conditions

a) In case of non-attendance (“no show”), there is no entitlement to a refund of the deposit.

b) If participation is terminated after the start of the event due to health reasons or personal misjudgment of one's abilities, no refund of payments already made will be issued.

c) No refund or compensation will be provided in case of weather-related, organizational, or safety-related changes to the event.

d) A (partial) refund will only be issued if the cancellation or termination is demonstrably due to gross negligence on the part of the organizer 

e) If cancellation occurs at least 30 days before the event starts, the deposit will be refunded in full.

f) For cancellations within 29 days or less before the event, the deposit will be retained.

g) If one of the two registered persons cancels and no replacement is found, the remaining participant must cover the additional costs for single occupancy of the previously booked double room.

Participants are requested to inform the organizer of any changes in the number of persons, health restrictions, or specific dietary needs (e.g., intolerances, allergies) no later than at the time of booking confirmation.

8. Insurance Coverage 

Participants are responsible for ensuring adequate insurance coverage. It is recommended to take out personal accident and liability insurance.

9. Disclaimer of Liability

The organizer assumes no liability for injuries resulting from natural events, personal negligence, or the behavior of other participants. The organizer is only liable for damages caused by intentional or grossly negligent conduct by its legal representatives or agents. Liability for damages relating to life, body, or health remains unaffected.

10. Audio, Video, and Photo Recordings During the Event

Audio, video, and photo recordings may be taken during the event. Participants agree to the free-of-charge use, editing, and publication of these recordings by ORTOVOX and affiliated companies of the Schwan-STABILO Group. Consent is voluntary and may be withdrawn at any time with effect for the future. Use of materials prior to withdrawal remains lawful. Please note that worldwide accessibility of published content on the Internet cannot be excluded.

11. Data Protection Information According to Art. 13 GDPR

Purposes and Legal Basis: Data processing is carried out exclusively for conducting the selection process, organizing the event, and — where consent is given — using image and video material in accordance with Art. 6 (1) a and b GDPR.

Storage Period: Personal data is stored for as long as necessary to conduct the event or until consent is withdrawn.

Data Subject Rights: Participants have the right to access, rectification, deletion, restriction of processing, data portability, and objection in accordance with Art. 15 et seq. GDPR. To exercise these rights, an email to datenschutz@schwan-stabilo.com is sufficient.

Right to Lodge a Complaint: Participants have the right to lodge a complaint with the competent data protection authority.

By registering, the participant confirms that they have read and understood the terms of participation, the disclaimer, and the data protection information.
